# How many people does Martyn’s Law count?

> Calculator for the 200 and 800 person thresholds: count the busiest foreseeable occasion, staff and volunteers included.

A calculator that adds up visitors, performers or participants, staff and volunteers, and anyone else on site at the busiest foreseeable occasion.

- Count people present at the same time, not the total through the door over a day.
- Include everyone: the public, staff, volunteers, contractors and performers.
- Use numbers you can reasonably expect, including foreseeable busy occasions such as a yearly concert or fair.
- The fire safety maximum capacity is a ceiling, not the test.
- Under 200: the premises duties are unlikely to apply. 200 to 799: standard tier. 800 or more: enhanced tier, unless they are qualifying premises wholly or mainly used for worship, childcare, primary or secondary education, or further education, which stay standard.
- Numbers are one part of the test; the use of the premises and whether they include a building matter too.
